Description
The Winter 2010 Morino Lodge (Japan) Ski Trip Contest ("Contest") begins on January 19, 2011 at 12:01 PM Pacific Time (“PT”) and ends on April 30, 2011 at 11:59 AM PT ("Contest Period"). The sponsor of the Contest is Evolucion Innovations, Inc. d/b/a evo (“Sponsor”), 122 NW 36th Street, Seattle, WA 98107.
Eligibility
NO PURCHASE NECESSARY TO ENTER OR WIN AND MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING. To be eligible to win, you must: (1) be 18 years of age or older; (2) be a legal U.S. resident; (3) not be an employee, officer, director or agent of Sponsor; (4) not an immediate family member or living in the same household of any individual identified in (3) above; and (5) have submitted a valid entry form in conformance with these Official Rules and any additional instructions set forth on the entry form. All federal, state and local laws and regulations apply. Void where prohibited or restricted by law.
How to Enter
No cost to enter. To enter, you must visit Sponsor’s website at www.evo.com (the “Website”) during the Contest Period and accurately complete and submit an entry form to Sponsor prior to the expiration of the Contest Period in conformance with these Rules and any additional instructions set forth on the entry form.. Incomplete, inaccurate, duplicate and non-conforming entries are void. To constitute a complete entry, you must provide your first and last name, address and valid e-mail address on the entry form where indicated and submit same in conformance with these Official Rules. Limit one (1) entry per person. In case of dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Entries made in any fashion other than submitting the entry via the Website are void. All late, lost, misdirected, incomplete, undelivered, scrambled or destroyed entries are deemed ineligible entries, regardless of the reason or party responsible. False or deceptive entries or acts will render the entrant ineligible. Entries become the official property of the Sponsor and will not be acknowledged or returned. Sponsor, including its employees and agents, will not accept electronic or other correspondence or telephone inquiries regarding the status of entries or the administration of the Contest.
By entering the Contest, each participant agrees to be bound by these Official Rules and by all decisions of Sponsor, whose decisions regarding all aspects of the Contest shall be final. In addition, each participant agrees that Sponsor may contact him or her via the email address and/or telephone number included on his or her entry form.
Grand Prize
One (1) Justfares Air and Hotel package for two (2) adults from Los Angeles to Narita/Tokyo, Japan. Includes round-trip economy airfare and five (5) nights’ double-occupancy accommodation in a standard room or better at Morino Lodge, Hakuba, Japan.
Travel must be completed by April 7, 2012. Approximate prize value: $7,000 USD.
Grand Prize Terms and Conditions
• Flights will be provided by Justfares and are subject to availability.
• Trip must be booked by calling Justfares at 1-877-681-8147.
• Flights must originate from Los Angeles International Airport (“LAX”).
• All travel must be booked and completed between dates specified herein for each prize and is subject to space availability at time of booking. Valid travel dates are from January 8, 2012 to April 7, 2012.
• Travel dates must be confirmed by August 1, 2011 and will be available if reserved prior to this date. After August 1, 2011 they will be subject to availability, confirmation cannot be given less than 21 days prior to requested travel dates after August 1, 2011.
• No changes permitted to reservations once date of travel is confirmed.
• The Grand Prize winner and their travelling companion(s) are responsible for: Any and all costs not expressly described herein including, without limitation, transportation between LAX and the Grand Prize winner’s and his/her traveling companion(s)’ home, applicable local air departure taxes, ground transportation, gratuities, merchandise, telephone calls, personal expenses of any nature for overnight layover, meals and beverages, service charges, in-flight meals and entertainment. Ground transportation will be arranged by Justfares.com. Grand prize winner is responsible for all federal, state and local taxes, fees and assessments, if any, associated with receipt of the Grand Prize.
• Obtaining sufficient personal travel insurance prior to departure, if desired.
• Obtaining and carrying all necessary travel documentation, such as passports and visas and complying with customs immigrations regulations.
• Grand Prize cannot be sold, converted into cash, is non-transferable and will not be refunded if unused. Grand Prize must be accepted as awarded and no substitutions, changes, or extensions are permitted.
• The use of upgrade certificates is not permitted for flights.
• The vacation package description and approximate value based on two (2) people travelling (not including taxes and fees) based on a Los Angeles departure. Both passengers must travel together on the same flights and dates.
Drawing and Odds
On or about May 1, 2011, Sponsor shall conduct a drawing through which one Contest winner will be randomly selected from among all eligible entries received in accordance with these Official Rules. Odds of winning depend on the number of eligible entries submitted.
The Grand Prize winner will be notified by mail, email and/or telephone. To claim the Grand Prize, the winner must: (1) respond as directed within seven (7) days of the first notification attempt; and (2) return to Sponsor, by the date and in the manner Sponsor directs in writing, (a) an Affidavit of Eligibility, Release of Liability and Publicity Release signed by the winner; and (b) a Release of Liability and Publicity Release signed by the winner’s travel companion(s) (or parent or legal guardian if travel companion is a minor). If the winner cannot be reached or fails to timely respond or comply with any of these requirements, or if Sponsor, in its sole and absolute discretion, determines the winner ineligible or disqualified, then, in Sponsor’s sole discretion, the winner may be disqualified and the prize forfeited. In such event, an alternate winner will be selected by random drawing from remaining eligible entries.
By accepting the Grand Prize, the winner and each travel companion(s) grants permission for Sponsor’s use of the name, hometown, likeness, photograph, voice and statements of winner and winner’s travel companion(s) for advertising and publicity purposes without further compensation or permission, unless prohibited by law. By accepting the prize, winner agrees to keep a travel log of the vacation experience and conduct interviews to be published for advertising/publicity purposes without further compensation or permission, unless prohibited by law.
Conditions of Participation
By entering, each Contest participant agrees to be bound by these Official Rules, such additional instructions as may appear on the entry form and the decisions of Sponsor, which shall be, in each instance and in all respects, final and at Sponsor’s sole and absolute discretion. Each Contest participant further explicitly agrees to forever and irrevocably release, defend, indemnify and hold harmless Sponsor and each of its officers, directors, employees, representatives, agents, insurers, successors and assigns, one and all (together “Released Parties”), from any and all liability, actions, causes of action, damages, actual, incidental or consequential, claims judgments, injuries, death, fines, penalties, losses, costs, expenses and demands whatsoever in law or equity, including all attorney or "expert" fees or costs, which you now have or may acquire, by reason of any personal injury, death, loss of or damage to others or to property, or any reason, occurring during or arising out of the Contest, your participation or inability to participate in the Contest; the acceptance, possession, attendance at, travel related to, defect of, use, inability to use or misuse of the prizes and any elements thereof; any change in the prizing (or any components thereof) due to unavailability, business or creative considerations, or due to reasons beyond Sponsor’s control; human error; any late, lost, stolen, mutilated, misdirected, illegible, delayed, garbled, corrupted, destroyed, incomplete, undeliverable or damaged online entries or in-store entries; any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other errors or malfunctions; any interruptions in or postponement, cancellation, or modification of the Contest; incorrect or inaccurate transcription, receipt or transmission of any part of the entry (including, without limitation, the entry information or any parts thereof); any technical malfunctions or unavailability of the Webiste, telephone network, computer online system, computer timing and/or dating mechanism, computer equipment, software, or Internet service provider, or mail or delivery service utilized by any of the Released Parties or by entrant Contest participant; interruption or inability to access the Contest, the Website or any online service via the Internet due to hardware or software compatibility or other problems; any damage to entrant’s (or any third person’s) computer and/or its contents related to or resulting from any part of the Contest; any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other errors or malfunctions, any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties, or any of their agents or employees; cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carrier(s), or other transportation companies, hotel(s), or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same; lost, stolen, damaged, delayed, or misdirected baggage; or lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof). The Grand Prize winner waives the right to 1) assert as a cost of winning the Grand Prize any and all costs of verification and redemption or travel to redeem said prize, and 2) claim any liability (including attorney's and experts fees and costs) which might arise from redeeming or seeking to redeem said prize (including travel related thereto). Prizes not claimed will not be awarded at Sponsor’s sole discretion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Winners List
For the name of the Grand Prize winner, mail a self-addressed stamped envelope within ninety (90) days after the end of the Contest entry period to: evo, 122 NW 36th Street, Seattle, WA 98107; attention: Hakuba Contest Winners.
Privacy Notice
Information Contest participants provide to Sponsor will be used to communicate with participants regarding the Contest and otherwise as set forth in Sponsor’s privacy policy as set forth on the Website. The Grand Prize winner’s name, city and state of residence may be posted on the Website.
